1. Acuerdo de consentimiento y relevo de responsabilidad

Favor de leer completamente el acuerdo de consentimiento y relevo de responsabilidad a continuación antes de aceptar y pagar.

El Participante que se identifica a continuación (el “Participante”) desea participar en la Liga de LEGO STEM y Robótica en Colegio Sonifel (el “Programa”).

Como contraprestación por permitir al Participante participar en el Programa y como condición para ello, Eureka Enrichment Services, Inc. (“Eureka”) exige que el Participante y sus padres/tutores legales se comprometan a cumplir con los términos de este Acuerdo de consentimiento para participar y liberación de responsabilidad (el “Acuerdo”). Favor de leer todo el acuerdo a continuación antes de aceptarlo.

El padre/madre/tutor del Participante entiende que la participación en el Programa es voluntaria. Con la intención de quedar legalmente vinculado, el padre/madre o los tutores legales del Participante celebran este Acuerdo de manera deliberada y voluntaria en su propio nombre y en el de sus representantes personales, herederos y familiares. Las referencias a un “Participante” en este Acuerdo incluyen al padre/la madre o a los tutores legales del Participante, salvo que se indique lo contrario.

1. Asunción de riesgos:

(a) El Participante y el padre/madre o tutor del Participante entienden que la participación en el Programa podría exponerlo a riesgos de lesiones y enfermedades, incluidas, a modo de ejemplo, lesiones y enfermedades provocadas por COVID-19 (ver a continuación) o otras enfermedades infecciosas y otras actividades asociadas con la participación en el Programa.

(b) COVID-19. El Participante y el padre/madre o tutor del Participante entiende y acepta que la participación en el Programa presenta ciertos riesgos y peligros para el Participante, tanto graves como menores, como consecuencia de la exposición al virus de la COVID-19. La COVID-19 es una enfermedad provocada por el virus SARS-CoV-2, declarada pandemia global por la Organización Mundial de la Salud. El Participante entiende que la COVID-19 se considera una enfermedad altamente contagiosa y que se transmite principalmente de persona a persona, incluso por personas asintomáticas. La COVID-19 tiene más probabilidades de propagarse cuando las personas mantienen un contacto cercano entre sí. El Participante entiende que, mientras participa en un Programa, el Participante estará en contacto cercano con otras personas, algunas de las cuales podrían estar infectadas por el virus y podrían contagiar la COVID-19.

El Participante y el padre/madre o tutor del Participante entienden y reconocen que, dada la naturaleza desconocida de la COVID-19, no es posible hacer una lista exhaustiva de cada uno de los riesgos de contraer la enfermedad. Sin embargo, algunos de los riesgos más frecuentes incluyen consecuencias para la salud, lesiones personales, enfermedades, discapacidad permanente e incluso la muerte, y pueden abarcar tos, falta de aire, dificultad para respirar, fiebre, escalofríos, temblores, dolor muscular, dolor de cabeza, dolor de garganta, pérdida del gusto, etc. (“Exposición a la COVID-19”).

El Participante entiende y reconoce que los riesgos de COVID-19 son inherentes a la participación en un Programa y que el Participante puede contraer COVID-19 como resultado de su participación en un Programa. El Participante acepta que asume conscientemente el riesgo de toda y cualquier exposición a la COVID-19. El Participante y el padre/madre o tutor del Participante entienden y aceptan que este Acuerdo incluye una liberación de responsabilidad y renuncia al derecho a presentar todo y cualquier tipo de reclamos relacionados con la exposición a la COVID-19, así como todo y cualquier tipo de reclamos por lesiones, discapacidad o enfermedades resultantes, incluida la muerte.

2. Participación sin síntomas de COVID-19:

El Participante acepta que no participará en persona en el Programa si él o cualquier persona que reside en la misma vivienda que el Participante ha tenido síntomas de COVID-19 durante los 14 días anteriores a la fecha de participación o ha tenido un resultado positivo en una prueba de COVID-19. Este requisito se aplica independientemente del estado de vacunación del Participante, salvo que las autoridades de salud pública emitan pautas actualizadas con respecto a la transmisibilidad de la COVID-19 por parte de personas completamente vacunadas y hasta tanto se emitan tales pautas. El Participante cumplirá con las pruebas de detección de COVID-19 o las prácticas de control de exposición al virus que podría adoptar Eureka como requisito para participar en el Programa y también cumplirá con los requisitos relacionados con la COVID-19 del estado o jurisdicción local en la que se ubica el Programa.

3. Liberación de todos los reclamos:

En contraprestación por la participación voluntaria del Participante en los Programas, el padre/madre o tutor del Participante asume la totalidad del riesgo de dicha participación y, por la presente, libera a FIRST, Eureka y a sus directores, funcionarios, empleados, otros participantes y agentes (“Partes Liberadas”) de todo reclamo, juicio, responsabilidad, acción y pretensión, por ejemplo, reclamos por culpa atribuida a las Partes Liberadas, que el Participante o sus herederos legales, representantes, sucesores, curadores y cesionarios tengan o puedan tener en el futuro y que surjan directa o indirectamente de la participación del Participante en el Programa. Esta liberación abarca cualquier pérdida o daño material o personal, o cualquier otra pérdida provocada o supuestamente provocada, en todo o en parte, por culpa leve (pero no por culpa grave ni dolo) de las Partes Liberadas.

4. Indemnización:

El Participante y su padre/madre o tutor acepta indemnizar a las Partes Liberadas respecto de todo reclamo, juicio, acción y pretensión, por ejemplo, reclamos por culpa, y otras responsabilidades, como honorarios de abogados, planteados por cualquier persona y que surjan o sean consecuencia directa o indirecta de la participación del Participante en el Programa, incluidos, a modo de ejemplo, lesiones personales o daños a la propiedad personal provocados por el Participante.

5. Compromiso de no iniciar acciones legales:

El Participante y el padre/madre o tutor del Participante se comprometen a no plantear nunca, en forma directa ni indirecta, ningún juicio, acusación, demanda, reclamo, queja ni pretensión en el marco del sistema legal, del sistema de equidad ni de otra manera en sede judicial ni en virtud de un sistema o procedimiento arbitral, contra las Partes Liberadas, que surja de la participación del Participante en el Programa.

6. Consentimiento para la grabación y recopilación de datos que le identifiquen personalmente y propiedad de las grabaciones:

(a) El padre/madre o tutor del Participante entiende que es posible que se hagan transmisiones en vivo, fotografías, filmaciones y otro tipo de grabaciones (en conjunto, las “Grabaciones”) de los participantes del Programa, incluso del Participante. El padre/madre o tutor del Participante presta su consentimiento para la realización de dichas transmisiones, fotografías, filmaciones y otras grabaciones, y para su uso (i) como parte de un registro del Programa y (ii) para promover públicamente a Eureka, FIRST y sus Programas.

(b) El padre/madre o tutor del Participante entiende que Eureka es el único y exclusivo propietario de todos los derechos personales, reales y el dominio sobre las Grabaciones, incluidos todos los derechos de autor y otros derechos de propiedad intelectual, y que no tendrá derecho a revisar y aprobar tales Grabaciones antes de que se utilicen o divulguen.

(c) El padre/madre o tutor del Participante presta su consentimiento para la recopilación y el procesamiento de datos que le identifiquen personalmente, de los tipos y para los fines que se expresen en la Política de privacidad de FIRST. La Política de privacidad de FIRST está disponible aquí o puede solicitar una copia enviando un mensaje por correo electrónico a Soporte del Equipo a customerservice@firstinspires.org. El padre/madre o tutor del Participante reconoce que ha leído y comprende la Política de privacidad de FIRST y presta su consentimiento afirmativo con respecto a ella.

7. Totalidad del Acuerdo/Ausencia de dispensa:

Este Acuerdo representa la totalidad del acuerdo entre las partes con respecto a las cuestiones establecidas en el presente instrumento y reemplaza y deja sin efecto cualquier otro acuerdo o entendimiento, sea verbal o escrito, y solo puede modificarse si media la aceptación y refrendación de un representante autorizado de Eureka por escrito. La dispensa de una obligación de una de las partes del Acuerdo por la otra parte no se interpretará como una dispensa de otras obligaciones o de la misma obligación en el futuro.

8. Divisibilidad y ejemplares:

Los términos de este Acuerdo son independientes entre sí. Si un término del Acuerdo se considera inexigible por parte de un juez, los términos restantes continuarán plenamente vigentes. Pueden suscribirse varias copias de este Acuerdo, todas las cuales constituirán un único y mismo acuerdo.

9. Jurisdicción:

El padre/madre o tutor del Participante reconoce y acepta que la validez, efecto y funcionamiento de este Acuerdo se determinarán de conformidad con las leyes de Puerto Rico (pero no con sus normas sobre conflicto de leyes), y acepta someterse a la jurisdicción de los juzgados estatales y federales con asiento en Puerto Rico.

1. Consent & Release Form

The Participant identified below (“Participant”) desires to participate as a member in the LEGO STEM & Robotics League (“Program”) at Colegio Sonifel.

In consideration of and as a condition of allowing Participant to participate in the Program, Eureka Enrichment Services, Inc. (“Eureka”) requires that the Participant’s parent or legal guardian agree to the terms of this Consent to Participate and Release Agreement (the “Agreement”). Please read and scroll to the bottom to before accepting this Agreement.

The Participant’s parent/legal guardian understands that participation in the Program is voluntary. Intending to be legally bound, Participant’s parent or legal guardian knowingly and voluntarily execute this Agreement on behalf of the Participant. References to “Participant” in this Agreement include the Participant’s parents or legal guardians unless otherwise noted.

1. Assumption of Risk:

(a) Participant’s Parents/Guardians understand that participation in the Program may expose Participant to risks of injury and illness including, without limitation, injury and illness resulting from COVID-19 (see below) and other infectious diseases and other activities associated with participation in the Program.

(b) COVID-19. The Participant and his/her Parents/Guardians understand and agree that participation in the Program presents certain risks and dangers to Participant, both serious and minor, arising from being exposed to the COVID-19 virus. COVID-19 is a disease caused by the virus SARS-CoV-2, declared by the World Health Organization to be a global pandemic. The Participant and his/her Parents/Guardians understand that COVID-19 is considered highly contagious and is primarily spread from person-to-person, including by asymptomatic persons. COVID-19 is more likely to spread when people are in close proximity to one another. The Participant and his/her Parents/Guardians understand that, while participating in the Program, the Participant will be in close proximity to other persons, some of whom may be infected by, and able to spread, COVID-19.

The Participant and his/her Parents/Guardians understand and acknowledge that, given the unknown nature of COVID-19, it is not possible to fully list each and every risk of contracting COVID-19. Nevertheless, some of the generally understood risks include health consequences, personal injury, illness, permanent disability and even death, and may include coughing, shortness of breath, difficulty breathing, fever, chills, shaking, muscle pain, headache, sore throat, loss of taste or smell, pain or pressure in the chest, confusion, upper respiratory distress syndrome, pediatric multi-system inflammatory syndrome, and other symptoms and risks (“COVID-19 Exposure”).

The Participant and his/her Parents/Guardians understand and appreciate that COVID-19 risks are inherent in participating in the Program and that the Participant may contract COVID-19 as a result of participating in the Program. The Participant and his/her Parents/Guardians agree that the Participant knowingly assumes the risk of any and all COVID-19 Exposure. The Participant and his/her Parents/Guardians understand and agree that this Agreement waives and releases the right to make any and all claims whatsoever related to COVID-19 Exposure and any and all claims for any resulting injury, disability, or illness up to and including death.

2. COVID-19 Symptom-Free Participation:

The Participant and his/her Parents/Guardians agree that the Participant will not participate in person in the Program if the Participant or any individual residing in the same home as the Participant has had any symptoms of COVID-19 during the 14 days preceding the date of participation or has tested positive for COVID-19. This requirement applies regardless of the vaccine status of the Participant unless and until guidance is updated by public health authorities regarding the transmissibility of COVID-19 by individuals who have been fully vaccinated. The Participant will comply with any COVID-19 screening or exposure control practices which may be adopted by FIRST when participating in the Program and will also comply with any COVID-19 requirements of the state or local jurisdiction in which the Program is located.

3. Release of All Claims:

In consideration for Participant’s voluntary participation in the Program, the Participant’s Parent/Guardian assumes all risk of such participation and hereby releases FIRST, Eureka and its directors, officers, employees, other participants, and agents (“Releasees”) from any and all claims, suits, liabilities, actions, and causes of action, including but not limited to claims of negligence on the part of the Releasees, which Participant, or his/her legal heirs, representatives, successors, conservators and assigns may have, now or in the future, which arise directly or indirectly from the Participant’s participation in the Program. This release covers any property or personal loss or damage or other loss caused or alleged to be caused, in whole or in part, by the ordinary negligence (but not gross negligence or intentional wrongdoing) of the Releasees.

4. Indemnification:

Participant and the Parents/Guardians agree to indemnify Releasees from and against any and all claims, suits, actions, causes of action including, but not limited to, claims of negligence, and any other liabilities, including attorneys’ fees by any person arising out of, or resulting directly or indirectly from the Participant’s participation in the Program, including, but not limited to, damage to personal property caused by the Participant or injury of any person caused by the Participant.

5. Covenant Not to Sue:

The Participant and the Parents/Guardians agree that he/she shall never institute or cause to be instituted, any suit, charge, demand, claim, complaint, or cause of action, in law, in equity, or otherwise, in any court, or in any arbitration system or procedure, against the Releasees arising out of the Participant’s participation in the Program.

6. Consent to Record and Collect Personally Identifiable Information, and Ownership of Recordings:

(a) The Participant and his/her Parents/Guardians understand that live broadcasts, photographs, videotapes, and other recordings (collectively the “Recordings”) may be made of participants in the Program, including the Participant. The Participant and his/her Parents/Guardians consent to those broadcasts, photographs, videotapes, and other recordings and the use thereof (i) as part of a record of the Program and (ii) to publicly promote Eureka, FIRST and the Program.

(b) The Participant and his/her Parents/Guardians understand that Eureka is the sole and exclusive owner of all right, title and interest in the Recordings including all copyrights and other intellectual property rights and that the Participant will not have any right to review and approve any such Recording before it is used or disclosed.

(c) The Participant and the Parents/Guardians consent to the collection and processing of personally identifiable data, of the types and for the purposes expressed in the FIRST Privacy Policy. The FIRST Privacy Policy is available here or by requesting a copy by emailing Team Support at customerservice@firstinspires.org. The Participant and the Parents/Guardians acknowledge they have read, understand, and affirmatively consent to the FIRST Privacy Policy.

7. Entire Agreement/No Waiver:

This Agreement represents the entire agreement between the parties with regard to the matters herein and supersedes any other agreement or understandings, whether written or oral, and cannot be changed unless agreed upon and signed by an authorized representative of Eureka in writing. Any waiver of any obligation of either party to the Agreement by the other party shall not be construed to be a waiver of any other obligations or the same obligation on a future occasion.

8. Severability and Counterparts:

The terms of this Agreement are independent of each other. If a term in the Agreement is deemed unenforceable by a court, the remaining terms shall remain in full force and effect. Multiple copies of this Agreement may be signed, all of which constitute one and the same agreement.

9. Jurisdiction:

The Participant and Participant’s Parents and Guardians acknowledge and agree the validity, effect, and operation of this agreement shall be determined according to the laws of Puerto Rico (but not its conflict of laws rules), and the Participant and the Parents/Guardians agree to submit to the jurisdiction of the state and federal courts located in Puerto Rico.
